Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("Customer", "you") and Let's Get Launched ("we", "us", "our"), a business located in British Columbia, Canada. By using the customer portal, signing up for an account, or purchasing any of our plans, you agree to these Terms.

1. The Service

We design, build, host, and maintain small-business websites. This includes a pre-built demo site, customization tools in this customer portal, hosting, domain setup help, an SSL certificate, a contact form, and ongoing support as described on our pricing page.

2. Accounts

You must provide accurate information when you sign up and keep it current. You are responsible for your account credentials and everything that happens under your account. Tell us immediately if you suspect unauthorized access.

3. Plans, Fees & Billing

• Setup fee: a one-time charge billed when you activate your site.
• Monthly subscription: recurring fee billed monthly in advance until cancelled.
• Annual plans: billed yearly in advance; non-refundable after the first 14 days.
• All prices are in Canadian dollars (CAD) unless stated otherwise, and exclusive of applicable taxes (GST/PST/HST).
• Payments are processed by Stripe. By providing payment details you authorize us to charge the applicable fees.
• Failed payments may result in suspension of your site after 7 days' notice.

4. Refunds

If you are not satisfied, email us within 14 days of your first payment and we will refund the setup fee and current month. After 14 days, fees are non-refundable, but you can cancel anytime to stop future charges.

5. Cancellation

You can cancel from your customer portal or by emailing hello@letsgetlaunched.com. Cancellation takes effect at the end of your current billing period. After cancellation we take your site offline and delete your content after 30 days.

6. Your Content

You keep ownership of everything you upload (text, photos, logos, etc.). You grant us a limited, worldwide license to host, display, and modify that content solely to provide the Service. You confirm that you have the right to use everything you upload and that it does not infringe anyone else's rights.

7. Our Work

We build your website on our own templates, code, and systems. Once your account is paid and in good standing you receive a perpetual license to use your completed website for your business. The underlying template code, portal, and tooling remain our property.

8. Acceptable Use

You agree not to use the Service to:

• Publish anything illegal, defamatory, hateful, or infringing.
• Distribute malware, phishing pages, or spam.
• Sell regulated goods where doing so is illegal in your jurisdiction.
• Scrape, overload, or attempt to break the Service or the portal.
• Resell or sublicense the Service without written permission.

We may suspend or terminate accounts that violate these rules, with or without notice.

9. Uptime & Support

We aim for high availability but do not guarantee uninterrupted service. Hosting runs on Netlify and outages outside our control may occur. Support is provided by email during normal business hours (Pacific Time, Monday to Friday).

10. Third-Party Services

The Service integrates with third parties (Stripe, Netlify, Resend, NocoDB, Google, and others). Your use of those services is subject to their own terms and privacy policies.

11. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, Let's Get Launched will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses. Our total liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid us in the 12 months before the claim.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your content, your use of the Service, or your violation of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced by email or in the portal at least 14 days before they take effect. Continued use after the effective date means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in it, without regard to conflict-of-law principles. Any dispute will be resolved in the courts located in British Columbia, Canada.
